1. Acceptance of These Terms

These Terms & Conditions ("Terms") govern your use of the Planted With Care // 2026 Awards website and your participation in the contest (the "Contest"). By submitting an entry, checking the consent box on the entry form, or otherwise using the Site, you agree to be bound by these Terms, our Official Contest Rules, and our Privacy Policy.

2. Eligibility

You must be at least 18 years old and a legal resident of the eligible region to submit an entry. Full eligibility requirements are set out in the Official Contest Rules.

3. Your Content and the Media License

By submitting photos, a story, or any other material ("Submitted Content") as part of your entry, you grant Planted with Care a non-exclusive, worldwide, royalty-free, sub-licensable license to use, reproduce, edit, publish, and display your Submitted Content — including your name, category, and general location — in connection with judging the Contest, promoting the Contest on our Site and social channels, and featuring winners in our editorial media, for as long as reasonably necessary for those purposes.

You retain ownership of your Submitted Content. You are not entitled to additional compensation for this use, except where required by law.

4. Your Representations

By submitting an entry, you represent and warrant that:

You own all rights to the photos and story you submit, or have obtained all necessary permissions to submit them;
Your Submitted Content does not infringe any third party's intellectual property, privacy, or other rights;
If any other identifiable person appears in your photos, you have their permission to submit and feature the photo, and you will not submit photos of minors without the consent of a parent or legal guardian;
Your Submitted Content is accurate and does not contain false, misleading, defamatory, obscene, or unlawful material.

5. Prohibited Conduct

You agree not to: submit content you do not have the right to share; attempt to submit multiple entries per person; interfere with the operation of the Site or entry process; or use the Site for any unlawful purpose.

6. Intellectual Property of the Site

All trademarks, logos, copy, and design elements of the Site (other than Submitted Content) are owned by Planted with Care or its licensors. You may not copy, reproduce, or use these materials without prior written permission.

7. Third-Party Tools

The Site uses third-party services, including Tally.so for entry form submission and Canva for generating winner graphics. Your use of those tools through our Site is also subject to those providers' own terms of service.

8. Disclaimer of Warranties

The Site and Contest are provided "as is" and "as available," without warranties of any kind, to the maximum extent permitted by law. We do not guarantee the Site will be uninterrupted, secure, or error-free.

9. Limitation of Liability

To the maximum extent permitted by law, Planted with Care and its affiliates, judges, and partners will not be liable for any indirect, incidental, or consequential damages arising from your participation in the Contest, use of the Site, or acceptance and use of any prize.

10. Indemnification

You agree to indemnify and hold harmless Planted with Care from any claims, damages, or expenses arising from your Submitted Content or your breach of these Terms.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms. Material changes will be reflected by an updated "Last updated" date.

12. Governing Law

These Terms are governed by the laws of New Jersey, without regard to conflict-of-law principles.
